REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br /> <br />March 27, 2017 <br /> <br />SUBJECT <br />Approval of Amended and Restated Stormwater Treatment Measures Maintenance <br />Agreement for the Commercial Remodel at 720 Bay Road, Woodside Technology Park <br /> <br />RECOMMENDATION <br />By motion, approve and authorize the City Manager to execute the Amended and <br />Restated Stormwater Treatment Measures Maintenance Agreement with BMR-Bay LP <br />for property at 700 Bay Road, 720 Bay Road and 740 Bay Road <br /> <br />BACKGROUND <br />BMR-Bay LP is the property owner of 700 Bay Road, 720 Bay Road and 740 Bay Road. <br />The three properties are contiguous and are bounded by Bay Road, Spring Street, <br />Woodside Road and Chestnut Street. The office complex is commonly known as the <br />“Woodside Technology Park.” The City and the property owner entered into a <br />Stormwater Treatment Measures Maintenance Agreement on August 14, 2015 for a <br />commercial remodel and parking lot reconfiguration of 740 Bay Road. <br /> <br />The new project is a 9,913 square foot patio with seating in place of the existing parking <br />area between the two buildings, 720 Bay Road and 740 Bay Road. The patio spans <br />both 720 Bay Road and 740 Bay Road and directs stormwater across property lines. <br />Therefore, this required the original agreement for 740 Bay Road to be amended and <br />restated to include the additional stormwater treatment measures not included in the <br />original agreement. The planning entitlements for this project were approved by the <br />Zoning Administrator in 2016. <br /> <br />ANALYSIS <br />The developer’s engineer completed the improvement plans compliant with Redwood <br />City Ordinances, City Standards, and project conditions of approval to the satisfaction of <br />the City Engineer. Improvements include new onsite stormwater bio-retention system <br />and other drainage improvements to mitigate the new impervious surface area. There <br />are no proposed improvements within the public right of way. The developer anticipates <br />completion of all project-related improvements by end of 2017. <br /> <br />ALTERNATIVES <br />The City Council may choose not to approve the amended and restated agreement for <br />the project or request revisions. <br />6.1.B. - Page 1
