ATTY/RESO.0030/CC RESO DECLARING 112-120 VERA AVENUE PUBLIC NUISANCE & DIRECTING RECONSTRUCTION <br />REV: 03-24-17 RL <br />Page 1 of 3 <br />RESOLUTION NO. <br /> <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />REDWOOD CITY DECLARING BUILDINGS AT 112-120 VERA <br />AVENUE TO BE A PUBLIC NUISANCE AND DIRECTING <br />RECONSTRUCTION AND REPAIR OR RAZING AND REMOVAL <br />THEREOF <br /> <br />WHEREAS, the Building Inspector of this City has determined that the buildings <br />located at 112-120 Vera Avenue are a public nuisance as defined by Section 9.5 of the <br />Redwood City Code because the building has become manifestly unsafe for the purpose <br />for which it is being used; the building exists and is maintained in violation of specific <br />requirements and prohibitions applicable to such building regulations of the City; the <br />building, because of dilapidation, deterioration and decay has been determined to be unfit <br />for human habitation and is unsanitary; the buildings are in such a condition as to <br />constitute a public nuisance; and <br /> <br />WHEREAS, the Fire Marshal of this City has determined that the buildings located <br />at 112-120 Vera Avenue are a public nuisance as defined by Section 9.5 of the Redwood <br />City Code because the buildings, because of their dilapidated condition, inadequate <br />exists, and other causes constitute a fire hazard; and <br /> <br />WHEREAS, the Police Department of this City has determined that the buildings <br />located at 112-120 Vera Avenue are a public nuisance as defined by Section 9.5 of the <br />Redwood City Code because the buildings have become so dilapidated or deteriorated <br />as to become a harbor for vagrants, criminals or immoral persons; and <br /> <br />WHEREAS, the Building Inspector has given notice to the owner of the buildings <br />located at 112-120 Vera Avenue, as evidenced by Exhibit A (Notice to Abate Nuisance), <br />to appear before this City Council to show cause, if any, why such building should not be <br />declared to be a public nuisance and abated in accordance with the provisions of Chapter <br />9 of the Redwood City Code; and <br /> <br />WHEREAS, the Affidavit of Posting of the Notice to Abate Nuisance is attached <br />hereto and marked Exhibit B and an Affidavit of Mailing the Notice to Abate is attached <br />hereto and marked Exhibit C; and <br /> <br />WHEREAS, this Council has received extensive evidence that the buildings <br />located at 112-120 Vera Avenue have become dilapidated and have numerous Building, <br />Fire and other Code violations and thus constitute a public nuisance. <br /> <br />7.B. - Page 13
