All such necessary <br /> improvements shall be constructed concurrently with the <br /> work being done on the structure for which the building <br /> permit is issued. ' " <br /> "Section 9.44. Section 309 is hereby added to the <br /> Building Code to read as follows: <br /> "'Section 309. (a) No building permit or <br /> certificate of occupancy shall be issued by the <br /> Building Official if the structure to be constructed or <br /> the portion to be remodeled lies within or fails to <br /> have the necessary setback distance from any area <br /> reserved for the construction, widening or extension of <br /> the city street system pursuant to action taken by the <br /> City Council. <br /> " , (b) No building permit or certificate of <br /> occupancy shall be issued by the Building Official if <br /> the structure to be constructed or the portion to be <br /> remodeled lies within any recorded property interest <br /> held for public purposes or public utility purposes.'" <br /> IISection 9.45.
