<br /> DCB:rks 6/28/84R <br /> DCB:sh 8/06/84R <br /> DCB:sh 8/17/84R <br /> DES:sh 10/25/84R <br /> DES:sh 11/26/84R <br />subparagraph, a "significant number of subscribers" or a "major <br />system outage" shall mean interruption in service or impairment <br />of service which affects more than twenty-five percent (25%) of <br />the subscribers of the CATV System for a period of twenty-four <br />(24) or more consecutive hours. <br /> (c) Refrain from increasing any rate, fee or charge to its <br />subscribers until such time as all violations found to have <br />occurred or existed pursuant to subparagraph (c) of Section 11 <br />have been cured. <br /> (d) Cease operating under this franchise, whereupon said <br />franchise shall be terminated by Grantor subject to such <br />reasonable terms and conditions as Grantor may specify in the <br />public interest. <br /> The provisions, and each of them, in this Section 12 are <br />mutually exclusive. The direction to comply with one or more of <br />the requirements specified hereinabove shall not be deemed a <br />waiver by Grantor of any and all other rights or remedies it may <br />have under this franchise, the CATV Ordinance, or any statute, at <br />law, or in equity. <br /> SECTION 13. SUCCESSORS. All duties, obligations and <br />agreements to be performed, and all rights, privileges and <br />benefits accruing hereunder to the Grantor and Grantee shall be <br />binding upon, and accrue to the benefit of, their respective <br />successors and assigns; provided that no assignment or transfer <br />of this franchise or any duty, obligation or agreement, or right <br /> 20 <br /> ~k.._.,", <br />
