<br /> DCB:rks 6/19/84R <br /> DCB:sh 8/02/84R <br /> DES:sh 10/25/84R <br /> DES:sh 11/26/84R <br />Grantee shall be permitted to use, operate and provide similar <br />facilities or properties rented or leased from another franchised <br />public utility or other lawful business. <br /> " (b) The Grantee may charge subscribers a connection fee <br />and also a fixed monthly charge, if filings pertaining thereto <br />are made and approved as herein provided including, but not <br />limited to, Sections 11. 86 and 11. 87 <br /> " (c) If a franchise has been granted pursuant to this <br />Article and the Grantee of that franchise constructs, operates <br />and maintains a CATV system exclusively through a telephone <br />company's facilities constructed, operated and maintained <br />pursuant to a state granted franchise and offers satisfactory <br />proof that in no event during the life of such franchise shall <br />the Grantee make any use of the streets independently of such <br />telephone company facilities, such Grantee shall be required <br />nevertheless to comply with all of the provisions hereof as a <br />'license' and in such event whenever the term 'Grantee' is used <br />herein, it shall mean and include ' licensee. ' <br /> "Section 11.73. No franchise, pursuant to this article, <br />shall be granted for a term longer than fifteen (15) years from <br />and after the operative date thereof. Any franchise may be <br />terminated before its expiration date if the City Council finds, <br />after notice and public hearing, that: <br /> (a) the Grantee has defaulted, or is in default in the <br /> performance of any material obligation of the franchise <br /> or under this article, or has defaulted in the <br /> performance of any material obligation in any other <br /> 4 <br /> _. __.ü__ <br />
