DUPLICATE ORIGINAL AMENDMENT TO JOINT USE AGREEMENT BETWEEN THE CITY OF REDWOOD CITY AND THE BELMONT-REDWOOD SHORES SCHOOL DISTRICT REGARDING JOINT USE OF THE SANDPIPER PARK SITE This Agreement is made this � day of to of al and between the CITY OF REDWOOD CITY, a municlp I corporatio of thAt to of California ("City") and the Belmont -Redwood Shores School District, a public school district in the County of San Mateo ("District"). RECITALS A. City is the owner of certain real property located within the City of Redwood City, County of San Mateo, State of California, as more particularly described in Exhibit A attached hereto ("Sandpiper Park"). B. District is the owner of certain real property located within the City of Redwood City, County of San Mateo, State of California, described in Exhibit B attached hereto ("Sandpiper School Property"), upon which District operates Sandpiper Elementary School ("Sandpiper School"). C. City and District (the "parties"), on or about June 9, 1995, entered into an Agreement for Joint Use of the Sandpiper Park Site ("Agreement"), attached hereto as Exhibit C, affecting the property identified in Exhibits A and B ("Sandpiper Joint Use Site"). Since entering into the Agreement, the Sandpiper Joint Use Site has been jointly, beneficially, and continually used by the parties for park and school purposes. D. To accommodate projected growth and reduce overcrowding, District wishes to expand Sandpiper School by constructing, at its expense, and operating a new District -owned classroom building ("New Classroom Building") on a certain portion of City -owned real property located within the Sandpiper Joint Use Site, as more particularly described and shown in Exhibit D attached hereto (the "Premises"). Upon completion of the New Classroom Building, it is projected that Sandpiper School will serve a total of approximately 786 K-8 District students, a significant proportion of whom will be residents of Redwood City who reside near Sandpiper School. E. City wishes to make the Premises available to District, through a long-term ground lease, for purposes of constructing and operating Sandpiper School including but not limited to the New Classroom Building. In partial consideration for District's use of the Premises, City and District wish to make certain amendments, as detailed below, to the Agreement.
