severally, for each and every such violation and noncompliance <br />respectively, be guilty of an infraction and, upon conviction thereof, <br />shall be ,punishable by: <br />"(1) A fine not exceeding Fifty Dollars ($50.00) for a first <br />violation; <br />"'(2) A fine not exceeding One Hundred Dollars ($100.00) for a <br />second violation of the same provision within one (1) year; <br />111(3) A fine not exceeding Two Hundred Fifty Dollars ($250.00) for <br />each additional violation of the same provision within - <br />one (1) year. <br />The imposition of any one penalty for any violation --shall not excuse <br />the violation or permitit to continue. Each and every day a violation <br />shall continue.shall be deemed to be a separate violation. <br />"(b) The Chief or his authorized representatives shall <br />enforce the provisions -of the Fire Code adopted by Section 12.7 <br />and as amended by this article and all orders, licenses, certificates, <br />permits and plans and specifications issued or approved thereunder <br />and shall have the authority to issue citations for violations <br />thereof." <br />SECTION 3. All former ordinances qr parts thereof conflicting ' <br />or inconsistent with the provisions of this ordinance or of the Code <br />hereby adopted are hereby repealed. <br />SECTION 4. If any section, paragraph, sentence or word of this <br />ordinance or of the Code hereby adopted should for any reason be found <br />invalid,. -it is intended that all other portions of this ordinance <br />independent o; the elimination herefrom of any such portion as may be <br />declaredinvalid shall be valid. <br />SECTION 5. This ordinance shall take -effect 30 days after the date <br />of its adoption; provided, however, that any building or structure lawfully <br />commenced by_ the completion of its foundation structure may be completed <br />-24- <br />
