SECTION 2. Section 40.11 of the Code of the City of Redwood City <br />is hereby amended to read as follows: <br />"Section 40.11 Appeals. Any interested party may appeal <br />any decision by the Commission pursuant to Section 40.10 by <br />filing a notice of appeal with the City Council not later than <br />ten days after the Commission's decision. Such notice shall be <br />accompanied by a fee of $100. Section 40.9 of the Code <br />appeal and the owners and occupants of <br />of the City of Redwood City is <br />hereby amended to read as follows: <br />"Section 40.9 Permit Approval Procedure. The following procedures <br />shall be followed in processing applications for <br />by said appeal, of the time and date <br />covered by his chapter: approval of work <br />"(a) The Building Official shall report any application for a <br />building permit to work on it designated historic site, his- <br />toric <br />tring. Whenever the application is to tear down, demolish, <br />construct, alter, remove, or relocate any improvement, or <br />any portion thereof, which has been designated a historic <br />landmark pursuant to the provisions of this chapter, the <br />Commission shall hold a public hearing <br />therein. The Com- <br />mission may hold public hearings on other applications as <br />they deem necessary. All decisions <br />interim and final, shall <br />be made at regular meetings of the Commission. The Com- <br />mission's decision shall be in writing and shall state the <br />findings of fact and reasons relied upon in reaching its <br />decision. This decision may be appealed to the City Council. <br />"(e) The }Tanning Department <br />may collect such fees for an <br />application pursuant to this section as would be charged by <br />the Building Department for <br />a similar building permit <br />application." <br />SECTION 2. Section 40.11 of the Code of the City of Redwood City is <br />hereby amended to read as follows: <br />"Section 40.11 Appeals. Any interested party may appeal any <br />decision by the Commission <br />pursuant to Section 40.10 by filing a <br />notice of appeal with the City Council not later than ten days after the <br />Commission's decision. Such <br />notice shall be accompanied by a fee of <br />$100. The City Council shall schedule a public hearing to be held no <br />later than 30 days after the <br />notice of appeal is filed and shall render <br />its decision within 10 days of said hearing date. At the public hearing, <br />the Council shall provide <br />a reasonable opportunity for all interested <br />parties to express their opinions. The City Clerk shall notify by mail <br />all applicants for the <br />appeal and the owners and occupants of all <br />properties affected by said appeal, of the time and date set for such <br />public hearing. The aforementioned <br />people shall also be notified by <br />mail of the Council's decision on the appeal." <br />SECTION 3.
