REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br /> <br />April 24, 2017 <br /> <br />SUBJECT <br />Consent to the Assignment and Assumption of Contract for Recycled Water Project <br />Consulting Services <br /> <br />RECOMMENDATION <br />By motion, approve and authorize the City Manager to consent to the assignment and <br />assumption of City’s recycled water project consulting services agreement by and <br />between Whitley Burchett and Associates Inc. and West Yost Associates Inc. <br /> <br />BACKGROUND <br />The City has an existing agreement with Whitley Burchett and Associates (WB) for <br />recycled water project consulting services. The original agreement and subsequent <br />amendments provide for: preparation and submission of a feasibility report, assistance <br />with regulatory compliance, and project implementation. <br /> <br />On March 20, 2017, per the requirements of the standing agreement, WB informed the <br />City of their acquisition by West Yost Associates (West Yost). West Yost will manage <br />WB’s existing contracts, including the City’s agreement for recycled water project <br />consulting services. WB is seeking consent from the City for assignment and <br />assumption of the contract by West Yost. <br /> <br />ANALYSIS <br />WB continues to provide ongoing regulatory compliance and project implementation for <br />the City under the existing agreement. Close to $52,000 remain unspent under the <br />existing agreement and staff recommends continuing with WB and West Yost until all <br />tasks are complete. <br /> <br />Staff is confident that WB and West Yost will provide reliable service that meets the <br />City’s needs. Staff has had positive prior experiences with West Yost and finds the firm <br />responsible and professional in their project management. Additionally, existing WB <br />staff will continue to execute the work for the City which will minimize any potential <br />disruptions or delays in the completion of services. <br /> <br /> <br /> <br /> <br />6.1.E. - Page 1
