A public agency that operates or intends to operate an ALPR system [to] <br />provide an opportunity for public comment at a regularly scheduled <br />public meeting of the governing body of the public agency before <br />implementing the program. <br /> <br />ANALYSIS <br />The Police Department has updated its Policy Manual to comply with the new <br />provisions of the law. The updated policy regarding Automated License Plate <br />Readers has been posted to the City website as required by California Civil Code <br />Section 1798.90.51(b)(1). Because the Department began using ALPR <br />technology prior to the passage of SB 34, compliance with the requirement that an <br />opportunity for public comment at a regularly scheduled public meeting of the <br />governing body of the public agency before implementing the program was not <br />possible. <br /> <br />The requested action provides an opportunity for public comment on the ALPR <br />policy as required by California Civil Code Section 1798.90.55, and will satisfy the <br />requirements of the new state law. <br /> <br /> <br />ALTERNATIVES <br />City Council may elect to take no action, or provide staff with further direction. <br /> <br />FISCAL IMPACT <br />Personnel costs associated with the ALPR program are included within the normal <br />staffing deployment model. <br /> <br />ENVIRONMENTAL REVIEW <br />This activity is not a project under CEQA as defined in the CEQA Guidelines, section <br />15378, because it has no potential for resulting in either a direct or foreseeable physical <br />change in the environment. <br /> <br />GREG FARLEY <br />LIEUTENANT <br /> <br />JR GAMEZ <br />CHIEF OF POLICE <br /> <br /> <br />6.1.H. - Page 2
