In addition, the Contractor will comply with any implementing requirements <br />FRA may issue. <br />ii. Age. In accordance with Section 4 of the Age Discrimination in Employment Act of 1967, as <br />amended, 29 U.S.C. § 623, the Contractor will refrain from discrimination against present <br />and prospective employees for reason of age. In addition, the Contractor will comply with <br />any implementing requirements FRA may issue. <br />iii. Disabilities. In accordance with Section 102 of the Americans with Disabilities Act, as <br />amended, 42 U.S.C. § 12112, the Contractor will comply with the requirements of U.S. Equal <br />Employment Opportunity Commission, "Regulations to Implement the Equal Employment <br />Provisions of the Americans with Disabilities Act," 29 CY R Part 1630, pertaining to <br />employment of persons with disabilities. Further, in accordance with Section 504 of the <br />Rehabilitation Act of 1973, as amended, 29 U.S.C. § 794, the Contractor will comply with the <br />requirements of U.S. Department of Transportation, "Nondiscrimination on the Basis of <br />Disability in Programs or Activities Receiving Federal Financial Assistance," 49 C.F.R. Part <br />27, pertaining to persons with disabilities. In addition, the Contractor will comply with any <br />implementing requirements FRA may issue. <br />The Contractor will not to discriminate on the basis of drug abuse, in accordance with the Drug Abuse <br />Office and Treatment Act of 1972 (P.L. 92-255), as amended, alcohol abuse, in accordance with the <br />Comprehensive Alcohol Abuse and Alcoholism Prevention, Treatment and Rehabilitation Act of 1970 <br />(P.L. 91-616), as amended, and to comply with Sections 523 and 527 of the Public Health Service Act of <br />1912 (42 U.S.C. §§ 290 dd-3 and 290 ee-3), as amended, relating to confidentiality of alcohol and drug <br />abuse patient records. In addition, the Contractor will comply with applicable federal implementing <br />regulations and other implementing requirements that FRA may issue. , <br />The Contractor also will include these requirements in each subcontract financed in whole or in part with <br />federal assistance provided by FRA, modified only if necessary to identify the affected parties. <br />9. ARRA FUNDED PROJECT <br />Funding for this Agreement has been provided through the America Recovery and Reinvestment Act <br />(ARRA) of 2009, Pub. L. 111-5. All Contractors, including both prime and subcontractors, are subject to <br />audit by appropriate federal or State of California (State) entities. The State has the right to cancel, <br />terminate, or suspend the Agreement if any Contractor or subcontractor fails to comply with the reporting <br />and operational requirements contained herein. <br />10.
