ATTACHMENT 1 <br />c. Based on substantial evidence in the record, the proposed Project is within the <br />scope of the previously approved Downtown Precise Plan and is adequately <br />described in the previously certified Downtown Precise Plan Program EIR for <br />purposes of CEQA. The mitigation measures and Statement of Overriding <br />Considerations associated with certification of the Program EIR addresses the <br />environmental effects of the Project. Accordingly, with the approval of this Project, all <br />applicable mitigation measures and the Statement of Overriding Considerations are <br />hereby reconfirmed and readopted. <br />d. As set forth in CEQA Guidelines sections 15162, 15163, and 15168, the proposed <br />Project will not result in any new environmental effects, or a substantial increase in <br />the severity of any previously identified environmental impact, or require new <br />mitigation measures beyond those identified in the Downtown Precise Plan Program <br />EIR and adopted upon approval of the Downtown Precise Plan. No new <br />environmental document is required. <br />e. As set forth in CEQA Guidelines section 15183, subdivisions (a) and (b), the <br />proposed Project is consistent with the Downtown Precise Plan (for which the EIR <br />was certified on January 24, 2011) which provides the necessary zoning to <br />accommodate the proposed development density. Further, as discussed in the IS <br />Checklist, there are no environmental effects which are peculiar to the project or its <br />site, nor are there any new significant effects that were not already identified and <br />analyzed in the certified EIR, nor are there any potentially significant off-site impacts <br />or cumulative impacts that were not already identified and analyzed in the certified <br />EIR, nor is there any new information which was not known at the time of the <br />certification of the EIR that identifies any significant effects which will have a more <br />severe adverse impact than discussed in the certified EIR. Further, as set forth in <br />subdivision (d) of CEQA Guidelines section 15183, the proposed Project is <br />consistent with the DTPP, and an EIR was prepared for the DTPP. <br />f. Pursuant to Guidelines section 15091(e), the documents and other materials that <br />constitute the record of proceedings upon which the City Council has based its <br />decision are located in and may be obtained from the Office of the City Clerk at 1017 <br />Middlefield Road, Redwood City, California. The City Clerk is the custodian of <br />records for all matters before the City. <br />Section 4.
