(iv) the City hereby agrees to accept any cure of any default made or tendered by <br />Borrower's limited partner on the same basis as if made or tendered by Borrower; and <br />(v) notwithstanding anything to the contrary contained in the City Loan Documents, the <br />parties hereby acknowledge and agree that that certain Housing Endowment and Regional Trust of <br />San Mateo ("HEART") loan in the original principal amount of $700,000 referenced in Exhibit A of <br />the Loan Agreement has been repaid in full. <br />7. Renresentations. The Assignor hereby represents and warrants that it has not <br />previously assigned, pledged, hypothecated or otherwise transferred any of its rights under the City <br />Loan Documents. <br />8. Effective Date.
