If the applicant fails to pay the Deposit or Fee the City shall not process any <br />permit on the project, nor perform work, until the Deposit or Fee is paid, and the <br />City may declare the amount owed past due and the City may collect such <br />amount by use of any available legal means. <br />5. Fees <br />The payment of fees shall be final and no refunds shall be given. <br />6. Unused Deposit <br />Deposits may be eligible for refund after a service has been provided, if the total <br />cost of the completed service is less than the deposit amount. The City shall <br />determine when a service provided is complete, and shall send at least three (3) <br />written notifications over the course of one calendar year that a deposit is eligible <br />for a refund. Deposits that qualify for refund but have gone unclaimed for a period <br />exceeding twelve months shall be considered forfeited. Forfeited deposits shall <br />be turned over to the General Fund for general City operations. <br />7. Appeals <br />a. Appeal of Any Permit by planning applicant <br />i. For applications paid by Fee – The applicant shall pay an appeal <br />Fee for the review of any denial of a planning application made by <br />the City in an amount set by resolution of the City Council. <br />ii. For applications paid by Deposit – The City shall bill any time and <br />material against the Deposit for work related to an applicant’s <br />appeal of the City’s denial of any planning application. The City <br />shall not charge any appeal Fee in addition to time and material <br />billed to the deposit. <br />b. Appeal of Any Permit by a party other than the planning applicant – The <br />appellant shall pay an appeal Fee of any decision made by the City in an <br />amount set by resolution of the City Council.
