b. City's Responsibilities <br />(1) The City will collaborate with Reclamation staff to prepare all environmental and <br />cultural resource documentation necessary to comply with the National <br />Environmental Policy Act, the Endangered Species Act, the National Historic <br />Preservation Act, and all other pertinent Federal planning, environmental, and <br />cultural resources laws, policies, and requirements. <br />(2) The City agrees to pay costs in the amount of $27,601 which will be incurred by <br />Reclamation for its assistance in the preparation of environmental compliance <br />documentation for this Project, including the oversight and execution of all pertinent <br />work. Such costs include, but are not limited to the costs Reclamation incurs <br />participating in meetings; reviewing planning, feasibility, environmental, and <br />cultural resource documentation; consulting with the California Office of Historic <br />Preservation and other Federal and State agencies; and reviewing and adopting all <br />required Federal documentation. These costs will include the appropriate salaries <br />and costs of participating Reclamation staff (including benefits, overhead, travel, and <br />per diem) and a proportionate share of Reclamation's administrative, <br />project/program management, and overhead costs. These costs shall not exceed <br />$27,601, unless the City provides written authorization for such additional work as <br />provided for in Section 3C, infra. <br />(3) The City will advance $27,601 to Reclamation upon execution of this Agreement. <br />(4) Funds provided by the City will be deposited in a U.S. Treasury account which will <br />be used by Reclamation to pay the costs described in Section 3.13.2, supra. Funds <br />must be deposited in such an account before any obligation or expenditure of funds. <br />c. Reclamation and the City's Responsibilities. Whenever the balance of funds received <br />from the City under this Agreement is reduced down to $2,500, Reclamation and the City <br />will meet and discuss the remaining work required for completing any reports and <br />associated analyses. Reclamation will provide written notification of the resultant cost <br />and scope of the remaining work identified and agreed upon. Through this Agreement, <br />the Parties intend that the cost of performing the work will be borne by the City rather <br />than Reclamation, and the City will have control over whether or not Reclamation <br />performs work in excess of the initial $27,601 advance. Work under this Agreement will <br />be immediately terminated if the advance balance is drawn down to $0 and is not <br />replenished. <br />4. Term of Aereement - This Agreement shall remain in full force and effect from the date <br />written above through, but not exceeding, November 2017. This expiration date may be <br />extended by mutual written agreement of the Parties. <br />5. Modification and Termination - This Agreement may be modified only through written <br />mutual agreement of the Parties. This Agreement may be terminated for any reason by either <br />party after 60 days written notification by the Party requesting termination to the other Party. <br />Contributed Funds Agreement—City of Redwood City Page 2 of 4 <br />
