any area within the City may be designated a historic district <br />by the City Council pursuant to Section 40.7 if it meets the <br />following criteria or other criteria established by the Planning <br />Commission pursuant to Section 40.5 of this chapter: <br />"(a) It exemplifies or reflects special elements of the <br />City's cultural, aesthetic, or architectural history; <br />or <br />"(b) It is identified with persons or events significant <br />in local, State, or National history; or <br />"(c) It embodies distinctive characteristics of a style, <br />type, period, or method of construction, or is a <br />valuable example of the use of indigenous materials <br />or craftsmanship; or <br />"(d) It is representative of the notable work of a <br />builder, designer, or architect. <br />"Section 40.7. Historic Designation Procedures. Historic <br />landmarks, historic sites, and historic districts shall be <br />established by the City Council in the following manner: <br />"(a) Any person may request the designation of an improve- <br />ment as a historic landmark or the designation of <br />a historic site or historic district by submitting <br />an application for such designation to the Planning <br />Commission. The Commission or City Council may <br />also initiate such proceedings on their own motion. <br />"(b) The Commission shall conduct a study of the proposed <br />designation and make a preliminary determination <br />based on such documentation as it may require, as <br />to its appropriateness for consideration. If the <br />Commission determines that the application merits <br />consideration, it shall schedule a public hearing. <br />"(c) The Commission shall file its decision in writing <br />with the City Clerk and the Building Official. If <br />the Commission decides not to hold a hearing, the <br />City Clerk shall mail notice of such decision to <br />the applicant. <br />"(d) If the Commission decides to hold a hearing on such <br />application, the City Clerk shall give notice of the <br />date, place, time and purpose of the hearing by <br />first class mail to all applicants, owners, and <br />occupants of the improvement or, in the case of a <br />proposed historic district, to applicants, owners <br />and occupants of all properties within the proposed <br />district, at least 20 days prior to the date set <br />for the public hearing, using the name and address <br />of such owners as shown on the latest equalized <br />-5- <br />
