<br />GRANT OF REVOCABLE ENCROACHMENT PERMIT FORTH E CONSTRUCTION OF UNDERGROUND CONDUITS
<br />WITH COMMUNICATION AND WATER LINES
<br />Pursuant to the provisions of Resolution No. 15551 of the Council of the City of Redwood City,
<br />adopted December 12, 2016, permission is hereby granted by this Revocable Encroachment Permit
<br />("Permit') to The Board of Trustees of the Leland Stanford Junior University, a body having corporate
<br />powers under the laws of the State of California ("Permittee") to construct underground conduits with
<br />water lines for heating and cooling purposes and with communication lines on City public right-of-way
<br />located on Broadway ("Subject Premises"), situated in the City of Redwood City, County of San Mateo, State
<br />of California (City"), for use by the adjoining Stanford development. The Stanford development is more
<br />particularly described in Exhibit "A" and the Subject Premises are more particularly described and depicted
<br />in Exhibit "B," attached hereto and incorporated herein by this reference.
<br />In consideration of the facts set forth above, the mutual promises and terms and conditions of this Permit
<br />and other valuable consideration, the adequacy of which is hereby acknowledged, the parties hereto agree
<br />as follows:
<br />ARTICLE I
<br />DEFINITIONS
<br />1.1 Facilities — means fiber optic cables, coaxial and copper cables, conduits, converters, splice boxes,
<br />cabinets, handholes, manholes, vaults, equipment, drains, surface location markers, appurtenances,
<br />and related facilities located or to be located in the Subject Premises and used for the transmission of
<br />telecommunication data or for water lines for heating and cooling purposes.
<br />1.2 Public Rights -Of -Way — means the surface of and the space above and below any street, road,
<br />highway, Right -Of -Way, alley, easement, pathway, sidewalk and other public way, including driveway,
<br />curb, gutter, paving or other surface and subsurface drainage structure or facility and any public place,
<br />or City property, now or hereafter existing as such within the City.
<br />ARTICLE II
<br />PERMIT REVOCABLE; INSTALLATION AND MAINTENANCE OF FACILITIES
<br />2.1 Property Usage. The use of the Subject Premises by Permittee shall be limited solely to underground
<br />conduits with communication lines and water lines for heating and cooling purposes and related uses
<br />as set forth in this Permit.
<br />2.2 Permit Revocable. This Permit does not constitute a deed, grant of easement, lease, conveyance, or
<br />transfer of any property interest and is revocable without cause at any time at the will of the Council
<br />of the City of Redwood City, effective immediately upon giving notice of such revocation to Permittee.
<br />2.3 Permitted Installations. During the term of this Permit, Permittee may install, maintain, operate,
<br />relocate and remove the Facilities within the Subject Premises subject to the issuance of required
<br />encroachment and building permits and approvals. The Facilities shall be shown and described in
<br />permit applications filed with the City Engineer and may be modified by subsequent permits approved
<br />by the City. All Facilities to be installed, maintained, operated, relocated and removed under this
<br />Permit shall be underground.
