<br /> MSR:dp:9/5/78R <br /> "Section 12.27 The City Manager, Chief of the Fire <br /> Department and the Fire Marshal shall act as a committee to <br /> determine and specify, after giving affected persons an <br /> opportunity to be heard, any new materials, processes or <br /> occupancies, which shall require permits, in addition to <br /> those now enumerated in the Fire Code. <br /> "Section 12.28 ( a) Any person, firm or corporation whether <br /> as principal, agent, employee, or otherwise, who shall violate <br /> or cause the violations of any of the provisions of the Fire <br /> Code adopted by Section 12.7 and as amended by this article, <br /> or fail to comply with any order, license, or permit made or <br /> issued thereunder, or who shall build in violation of any <br /> detailed statement of specifications or plans submitted and <br /> approved thereunder and from which no appeal has been taken, <br /> or who shall fail to comply with such an order, license, or <br /> permit as affirmed or modified by the Councilor by a court <br /> of competent jurisdiction within the time fixed therein, shall <br /> severally, for each and every such violation and noncompliance <br /> respectively, be guilty of an infraction and, upon conviction <br /> thereof, shall be punishable by: <br /> (1) A fine not exceeding Fifty Dollars ($50.00) <br /> for a first violation; <br /> (2) A fine not exceeding One Hundred Dollars <br /> ($100.00) for a second violation of the same <br /> provision within one (1) year; <br /> (3) A fine not exceeding Two Hundred Fifty Dollars <br /> ($250.00) for each additional violation of the <br /> same provision within one (1) year. <br /> The imposition of anyone penalty for any violation shall not <br /> excuse the violation or permit it to continue. Each and every <br /> -23- <br /> ,---". <br />
