<br />a request. Hearing on the appeal shall be held by the <br />City Council within thirty (30) days from the date of <br />filing the notice of appeal. The appellant, the Building <br />Official and such other persons as the Council may deem <br />appropriate, shall be heard at the hearing on such appeal. <br />Upon conclusion of the hearing, the Council may affirm, <br />reverse or modify the decision of the Building Official <br />insofar as the required findings are concerned. If the <br />Council fails to make a decision within thirty (30) days <br />after the date of the filing of such appeal, the decision <br />of the Building Official shall be deemed to be affirmed. <br />The Council's determination on the appeal shall be final. <br /> "Section 27.87. Any variance from the strict <br />application of this Article, granted pursuant to <br />Section 27.85, shall be revoked by the Building Official: <br /> " (a) Upon receipt by him of notice from the <br /> Health Officer that the private sewage <br /> disposal system constructed in lieu of <br /> compliance with Section 27.81 constitutes <br /> a menace to public health; or <br /> " (b) Upon a determination by him that the <br /> special circumstances considered in <br /> granting the variance have changed to <br /> the extent that strict application of <br /> Section 27.81 would no longer constitute <br /> an undue hardship upon the owner of such <br /> property. <br /> "Section 27.88. Any private sewage disposal system <br />permitted pursuant to Section 27.85 shall be designed, <br />constructed and maintained in accordance with the procedures <br />set forth in Section 27.89 through 27.92, inclusive. <br /> "Section 27.89. It shall be unlawful for any person <br />to construct, alter, repair, maintain, replace, put into <br />use or cause to be used, any private sewage disposal <br />system, septic tank, cesspool, seepage pit, drainage <br />field or leaching system within the City without first <br />obtaining a variance from the strict application of <br /> -5- <br /> ........". <br />
