Page 26 of 27 <br /> <br />ALTERNATIVES <br />1. The City Council may choose to deny the appeal and approve a modified project <br />design. <br />2. The City Council may choose to continue the item to a future meeting and direct <br />Staff and/or the Applicant to provide additional information or analysis. <br />3. The City Council may uphold the appeal and overturn the Planning Commission’s <br />project approval. <br /> <br />FISCAL IMPACT <br />Review of the proposed project is subject to the City’s Cost Recovery System; <br />therefore, direct costs during the entitlement process associated with staff and <br />consultant time are covered by an applicant deposit. Should the appeal be denied and <br />the project approved, the Applicant will be required to pay all associated development <br />impact and permitting fees, as applicable and as established by ordinance and/or the <br />terms of any agreements between the Applicant and the City. <br /> <br />ENVIRONMENTAL REVIEW <br />In 2010, an Environmental Impact Report (State Clearinghouse #2006052027) was <br />prepared to assess potential impacts resulting from the implementation of the DTPP. <br />The DTPP established new land use, development, and urban design regulations for <br />the 183-acre DTPP area, including the potential for up to 2,500 net new dwelling units, <br />and 100,000 net new square feet of retail development. The DTPP Environmental <br />Impact Report (EIR) was certified by the City Council on January 24, 2011. <br /> <br />An Initial Study checklist was prepared to consider whether any new effects not <br />identified in the DTPP EIR may be created by construction of the proposed 612 <br />Jefferson Avenue project, and was recently updated to address CEQA Guidelines <br />section 15183.3 as well as Public Resources Code Sections 21159.21 and 21159.23, <br />referenced below. The proposed project would bring the total number of net new <br />dwelling units approved under the DTPP to 2,202. The Initial Study checklist confirmed <br />that the proposed project would not result in any new environmental impacts or <br />substantial increase in the severity of any previously identified environmental impact <br />beyond those previously identified in the DTPP program EIR. Nor would the project <br />require new mitigation measures beyond those identified in the DTPP program EIR and <br />adopted upon approval of the Downtown Precise Plan. In addition, the Project is <br />consistent with the Downtown Precise Plan, as discussed herein, and there are no <br />Project-specific environmental effects that are peculiar to the Project or the site. Thus, <br />no further environmental review is required, pursuant to sections 15162, 15163, 15164, <br />15168, and 15183 of the CEQA Guidelines. Finally, the scope of environmental review <br />may be limited pursuant to section 15183.3 of the CEQA Guidelines, or the project may <br />be exempt under Public Resources Code Sections 21159.21 and 21159.23, as further <br />explained in the Initial Study. <br /> <br /> <br />8.A. - Page 26
