REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br /> <br />June 12, 2017 <br /> <br />SUBJECT <br />Final Acceptance – 1092 2nd Avenue Subdivision <br /> <br />RECOMMENDATION <br />By Motion, accept the construction improvements for 1092 2nd Avenue, and authorize <br />the release of the bonds in accordance with the Subdivision Improvement Agreement <br /> <br />BACKGROUND <br />On September 24, 2014, the Subdivision Committee approved the Tentative Parcel Map <br />to subdivide one existing residential lot into to lots. The Construction Permit, approved <br />and issued by the City, required the developer to install new water and sewer services, <br />and install new sidewalk and a wheelchair ramp across the frontage of the property. <br /> <br />Prior to this subdivision occurring, a single home was located at 1092 2nd Avenue. This <br />home has been demolished, and the larger lot was divided into two smaller lots. On one <br />of the new lots, located at 1092 2nd Avenue, a home has been approved and <br />constructed. The other lot, located at 181 Broadway, does not yet have an approved <br />home, but all of the services and right-of-way improvements have been constructed. <br />“1092 2nd Avenue” is the name of this project subdivision, and the title of the <br />Improvement Agreement, however, the recommended Council action is to accept the <br />improvements for both properties (1092 2nd Avenue and 181 Broadway). <br /> <br />ANALYSIS <br />The developer, Nicholas Ceschin, has completed the construction of improvements in <br />accordance with the Agreement, the tentative parcel map, the conditions of approval, <br />the plans and specifications, and to the satisfaction of the City’s Engineering and <br />Transportation Division. <br /> <br />The developer provided a faithful performance bond and a labor and material bond, <br />each for $85,939.50, and both can be released at this time. These bonds will be <br />replaced by a maintenance bond for $8,593.95 (10%), which will be held for a period of <br />one year. The maintenance bond is a warranty in the event any of the improvements fail <br />within a one-year period. <br /> <br />ALTERNATIVES <br />6.2.A. - Page 1
