The procedure for prorata reduction in vested individual supply guarantees set forth in Section 2 of Exhibits K-3 to the Master Agreement shall be utilized in the event that combined water use by Hayward and Estero exceeds 28.029 MGD for any period of three consecutive years. In doing so, the guarantees shown on Exhibit A hereof shall be deemed to be each Suburban Purchaser's individual supply guarantee at the ending of "vesting period N-1". The guarantees vested as of June 30, 1987 shall be deemed to be the individual supply guarantees at the end of "vesting period N-2". The guarantees shown on Exhibit K-1 of the Master Agreement shall be deemed to be the individual supply guarantees at the end of "vesting period N-3". 5 . Nothing contained herein shall constitute an acknowledgement by this City that San Francisco is obligated or entitled to reduce this City's supply guarantee in the circumstances described herein and the provisions of Section 7.02(b) (4) of said Master Agreement to that effect are expressly reaffirmed, nor shall the provisions hereof be deemed in derogation of the reservations of claims by the Suburban Purchasers to water in excess of the Supply Assurance (§7.04, Master Agreement) nor shall the provisions hereof be deemed to alter, amend or modify Section 9.10 of the Master Agreement. * * * 5 12147 -----.-
