5. If Declarant, or its successors or assigns, defaults in the performance of any <br />covenant or condition of this Declaration of Restrictive Covenant, written notice of such <br />default may be given to Declarant per the provisions of Section 3 and Declarant, or its <br />successors or assigns, must commence corrective work necessary to cure the default within <br />thirty (30) days of receipt of the written notice. In the event of any uncured default after thirty <br />(30) days, the City may record a Notice of Violation against the Property in addition to <br />pursuing any available legal or equitable remedies, including damages.
