<br />ALTERNATIVES <br />Council may choose to not authorize execution of the agreement. If the agreement is <br />not executed and the City proceeds with the design and construction of the BC/AC <br />Project, additional funding will be needed to complete the project. <br /> <br />FISCAL IMPACT <br />The LPS Agreement will allow the City to submit invoices to ABAG/SFEP and, in turn, <br />DWR for reimbursement of costs incurred for construction of the BC/AC Project. <br />Funding for the BC/AC Project is appropriated under the Capital Outlay Fund. The LPS <br />Agreement has a matching requirement of $890,600 from the City. As of April 30, 2017, <br />the Capital Outlay Fund has a balance of $1,971,918.38 for Bayfront Watershed <br />Management and Habitat Restoration, which is more than enough to meet the matching <br />fund requirement. The $1,135,000 grant funding would offset funding from the Capital <br />Outlay Fund or any other funding sources appropriated for the project. Total cost for the <br />BC/AC Project is not finalized and additional funding sources from grants and <br />contributions from other agencies are being pursued. <br /> <br />ENVIRONMENTAL REVIEW <br />The LPS Agreement is not a project under CEQA as defined in the CEQA Guidelines, <br />section 15378, because it will not result in either a direct or reasonably foreseeable <br />indirect physical change in the environment. Also, the LPS Agreement is a funding <br />mechanism that does not involve commitment to a specific project which may result in a <br />potentially significant physical impact on the environment. The agreement does not <br />obligate the City or ABAG to construct the BC/AC Project. However, when the design <br />and environmental review are completed for the BC/AC Project, CEQA and NEPA <br />consideration and action will be conducted at the appropriate time and before <br />commencing with any physical work, building on the EIS/EIR already certified for the <br />Salt Ponds Project, which analyzed the BC/AC Project under one of the Salt Ponds <br />Project alternatives. <br /> <br /> <br />AHMAD HAYA <br />SENIOR CIVIL ENGINEER <br /> <br /> <br /> <br />AARON AKNIN <br />ASSISTANT CITY MANAGER AND COMMUNITY DEVELOPMENT DIRECTOR <br /> <br />6.1.D. - Page 3
