C. Amend RCN Franchise Agreement (801) <br />ORDINANCE 2275 OF THE CITY COUNCIL OF THE CITY OF REDWOOD CITY <br />APPROVING AN AMENDMENT OF THE FRANCHISE BETWEEN THE CITY OF <br />REDWOOD CITY AND RCN TELECOM SERVICES, INC., FORMERLY RCN <br />TELECOM SERVICES OF CALIFORNIA, INC. TO CHANGE THE METHOD BY WHICH <br />CONSTRUCTION COMPLIANCE IS REGULATED AND TO PROVIDE FOR THE <br />CREATION OF A MUTT- JURISDICTIONAL FIBER NETWORK WITHIN REDWOOD <br />CITY AND NEIGHBORING COMMUNITIES (First reading on September 13, 2004) <br />7:20 p.m. — Council Member Hartnett arrived <br />E. Contract renewal with Third Party Administrator (TPA) for workers' compensation <br />Administration services, Claims Management Inc. (CMI) for the period of October <br />1, 2004 through June 30, 2005. (304) <br />Council Member Foust asked for clarification regarding the Joint Powers <br />Authority's purview and the TPA component. She emphasized that there was a <br />differential and it does not penalize the City within the JPA and that the City <br />remains with CMI. <br />Human Resources Director Rivera -Pena explained the situation and stated that <br />on October 14 she goes before the JPA board to gain support to allow the City to <br />continue in the JPA under the following conditions: That in April the City will <br />know whether it is proceeding with the JPA's selected TPA or going on a <br />separate path. <br />Recommendation: <br />M/S Foust/Howard to authorize staff to extend agreement with Claims <br />Management Inc. (CMI) to act as their party administrator for the City's self - <br />insured workers' compensation program for the period of October 1, 2004 <br />through June 30, 2005. The motion passed by a unanimous voice vote by <br />those present with Council Member Ruskin absent. MINUTE ORDER 04 -184 <br />M/S Foust/Howard to adjourn the Redevelopment Agency meeting.
