09/27/2004 <br />deposited, the City shall remit to the applicant the different between said <br />final cost and the amount deposited. <br />ii. Projects with a land area of one quarter of an acre or more. For <br />a project which consists of one quarter of an acre or more of land area <br />and requires the preparation of an environmental impact report, an <br />applicant shall pay the actual cost of preparation thereof as hereinafter <br />provided. Upon determining that an environmental impact report is <br />required for a project, the Planning Director shall calculate the estimated <br />cost of the preparation of such report pursuant to the provisions of the <br />City Council's Cost Recovery Policy for Planning Related Major Project <br />Applications adopted on September 27, 2004, as that policy may be <br />amended from time to time. <br />(d) Fee for Preparation by Consultant, Administration Fee, Projects With a <br />Land Area of Less than One Quarter of an Acre For a project which <br />consists of less than one quarter of an acre of land and a negative <br />declaration or environmental impact report is to be prepared by a <br />consultant pursuant to the provisions of paragraph 7(b) (2), or paragraph <br />7 (c) (3) below, the applicant shall pay to the City the total estimated sum <br />for the preparation of such negative declaration or environmental impact <br />report prior to the award of the agreement by the City to the consultant. <br />In the event the actual amount to be paid by the City pursuant to such <br />agreement exceeds the sum so deposited, the applicant shall pay the <br />difference upon notification thereof by the City, and in the event said final <br />amount is less than the amount so deposited, the City shall remit to the <br />applicant the difference between the actual amount and the amount <br />deposited upon completion of the negative declaration or environmental <br />impact report by the consultant. <br />In addition to the foregoing amount to be paid for the preparation of the <br />negative declaration or environmental impact report by a consultant, the <br />applicant shall pay to the City an administration fee in the amount of <br />$100, or ten percent of the actual amount paid by the City to the <br />consultant, whichever is greater. The full estimated amount shall be paid <br />at the time the total estimated sum for the preparation of the negative <br />declaration or environmental impact report is deposited with the City and <br />the remaining balance, if any, shall be paid upon completion of such <br />declaration or report, and prior to review thereof by the Planning <br />Commission." <br />4.
