deems it necessary, in City's sole discretion, City shall have the right to remove any such <br />property or improvements and City shall not be responsible for restoring or returning the same to <br />its prior condition. <br />5. Installation of Facilities. Licensee may install certain facilities consisting of a 12 -inch <br />ductile iron pipe on the License Area only upon satisfaction of the following conditions, which <br />are for the sole benefit of City: <br />(a) Aonroval of Plans and Soecifications. Licensee shall install the permitted <br />facilities in accordance with plans and specifications (including drawings) approved in advance <br />and in writing by SFPUC and attached hereto as Exhibit D (the "Approved Plans"). The <br />Approved Plans may be revised or amended only with prior written approval of SFPUC after <br />SFPUC's Bureau of Environmental Management has determined that no further environmental <br />review is required by CEQA as a result of any such revision or amendment. <br />(b) Enerev Service and Related Facilities. If Licensee seeks electrical service for <br />use in the Licensed Area or for any licensed facilities, Licensee shall contact the Interconnection <br />Services Department in the Power Enterprise of the SFPUC to arrange for service. Licensee <br />agrees that it shall purchase all electricity necessary for its operations at the Licensed Area from <br />the SFPUC, at the SFPUC's standard rates charged to third parties, unless and to the extent City <br />is unwilling or unable to provide same to Licensee. The SFPUC is the provider of electric <br />services to City property, and the SFPUC's Interconnection Services Department coordinates <br />with Pacific Gas and Electric Company and others to implement this section. Except as provided <br />above with respect to any electricity services provided by the SFPUC, Licensee shall make <br />arrangements and pay for all utilities and services furnished to the License Area, including gas, <br />electricity, water, sewage, telephone and trash collection services, and for all deposits, <br />connection and installation charges. <br />Except as otherwise provided in this License, the SFPUC has no responsibility or liability <br />of any kind with respect to any utilities that may be on or about the Licensed Area. Licensee has <br />the sole responsibility to locate any utility facilities within the Licensed Area and protect them <br />from damage resulting from Licensee's use of the Licensed Area. <br />(c) Permits. Licenses. and ADnrovalS. Before beginning any work in the License <br />Area, Licensee shall obtain any and all permits, licenses and approvals (collectively, <br />"Approvals") of all regulatory agencies and other third parties that are required to commence, <br />complete and maintain the permitted work. Promptly upon receipt of such Approvals, Licensee <br />shall deliver copies of them to SFPUC. Licensee recognizes and agrees that no approval by <br />SFPUC for purposes of Licensee's work hereunder shall be deemed to constitute the approval of <br />any federal, state or local regulatory authority with jurisdiction, and nothing herein shall limit <br />Licensee's obligation to obtain all such regulatory Approvals, at Licensee's sole cost. <br />(d) Limits of Citv's or SFPUC's Consent. City's or SFPUC's consent to or <br />approval of any improvements, equipment, or fixtures shall not relieve Licensee or its engineers, <br />architects, or contractors from any liability for negligence, errors, or omissions associated with <br />the design and construction thereof.
