<br /> (the "Alternate Leased Premises ") , subject to the terms set forth <br /> below; provided, however, that the reason for the relocation is <br /> that Lessor has decided to proceed with its water tank <br /> replacement project replacing the two wood water tanks currently <br /> located on the Emerald Lake Hills Water Tank Property. <br /> (b) The size, location and dimensions of the Alternate <br /> Leased Premises shall be chosen by Lessor but must, in Lessee I s <br /> reasonable judgment, be at least as suitable for purposes of <br /> operating a communications facility as the size, location and <br /> dimensions of the Leased Premises. If the Alternate Leased <br /> Premises are not suitable for Lessee's operations, as determined <br /> by Lessee in its reasonable judgment, then Lessor shall not <br /> require Lessee to relocate to such Alternate Leased Premises and <br /> Lessee shall remain on the Leased Premises until the expiration <br /> or earlier termination of this Lease. <br /> (c) Lessee shall not be required to relocate the Lessee <br /> Facilities to any location which would result in any <br /> deterioration or diminution of the quality of communication <br /> services or other services provided by Lessee from the Leased <br /> Premises, nor shall Lessee be required to conduct such relocation <br /> in a manner which would cause any deterioration or diminution ot <br /> such quality or which would cause any interruption of such <br /> service. <br /> (d) The relocation of the Lessee Facilities to the <br /> --/ <br /> Alternate Leased Premises shall not cause the Rent payable under <br /> the Lease to be increased. <br /> (e) The relocation of the Lessee Facilities to the <br /> Alternate Leased Premises shall be accomplished by Lessee a: <br /> Lessee's sole cost and expense. <br /> G:\SITES\l..EASING\S99A\CITYLSE.DOC SITE #S99A 23 <br /> -- <br />
