undertakings and agreements of Licensor, or for the purpose of binding Licensor personally or the assets of Licensor, except Licensor's interest in the Property. Except for the indemnity obligations set forth in this License, and otherwise notwithstanding anything to the contrary in this License, Licensee and Licensor each waives any claims that each may have against the other with respect to consequential, incidental or special damages, however caused, based on any theory of liability. 22. RF SIGNAGE AND NOTICES. 22.1 Licensee, and any Authorized Sublicensees, shall install signs alerting the public, but especially workers and public safety officials of any radio frequency emissions or other safety issues. These signs shall comply with OSHA 1910.145 and OSHA CFR 1926.200. 23. AMENDMENTS. 23.1 The provisions of this License may be amended only by mutual consent of the Parties expressed in writing and executed by authorized representatives of both parties. 24. NO RELOCATION ASSISTANCE. 24.1 Licensee acknowledges that Licensee is not entitled to relocation assistance, or any other benefits under the Uniform Relocation Assistance Act, or any other applicable provision of law upon termination of this License. Licensee hereby waives and releases Licensor from any claims to any relocation assistance, or any other benefits under the Uniform Relocation Assistance Act, or any other applicable provision of law. 25. TIME. 25.1 Time is of the essence of this License. 24. TERMINATION OF EXISTING LEASE. 24.1 As of the Commencement Date, the Existing Lease is hereby terminated and without the necessity of a further writing exchanged between Licensor and Licensee. Neither Licensor nor Licensee shall have any further rights or remedies under the Existing Lease; provided, however, that either Party's indemnity obligations under the Existing Lease, if any, shall survive the termination of the Existing Lease. All obligations of each Party are deemed to have been fully performed and discharged, and each party hereby fully releases the other from all claims thereunder to the maximum extent permitted under all applicable Laws. 25. MEMORANDUM OF LICENSE. 25.1 Contemporaneously with the execution of this License, the Parties will execute a recordable Memorandum of License substantially in the form attached as Exhibit "C". Either Party may record this Memorandum of License at any time during the Term, in its absolute discretion.
