<br />Page 6 <br />PART II <br />REMODELING, USE, OPERATION AND MAINTENANCE OF LIBRARY <br />1. USE OF LIBRARY. During the term of this Agreement as set forth in Part IV, Section 1, City shall <br />have the sole right to the use and occupancy of the portion of the building designated as "Library" <br />on the plans and specifications for the "Building Remodel" dated December 6, 1994, and subsequent <br />addenda all of which are on file in the office of the County Manager. Said Library consists of <br />approximately 3,200 square feet. City shall also have the common use of the public areas which <br />include the lobby, public restrooms and Building ingress/egress areas. City shall use the Library <br />for the operation of a branch library for the use and enjoyment of the general public including <br />residents of unincorporated San Mateo County. <br />City shall not use or permit the Library to be used for any other purpose without the prior <br />written consent of County's Board of Supervisors, <br />City shall not do or permit anything to be done in or about the Premises nor bring or keep <br />anything therein which will in any way increase the existing insurance rate of or affect any fire or <br />other insurance upon the Premises or any of its contents, or cause cancellation of any insurance <br />policy covering the Premises or any part thereof or any of its contents. City shall not use or allow <br />the Premises to be used for any unlawful purpose, nor shall City cause, maintain or permit any <br />nuisance in, on or about the Premises. City shall not commit or suffer to be committed any waste <br />in or upon the Premises. <br />2. REMODEL OF LIBRARY. County shall remodel or cause the remodel of the existing building on <br />County's Parcel in accordance with the plans and specifications dated December 6, 1994, and <br />subsequent addenda, on file in the office of the County Manager. The construction contract shall <br />be awarded by the County to contractor(s) licensed under the laws of the State of California. Such <br />construction contract shall be let and administered and the work shall be performed in accordance <br />with County policy. <br />When County, in its opinion, has completed remodeling the Building, it shall notify the City in <br />writing within 10 days from the date of completion of said remodeling. The City shall inspect the <br />Library and when the modifications have been completed consistent with the approved plans and <br />specifications as referenced hereinabove, City may move its personal property into the Library. <br />Rwe HSA/Library Agreement - Part II <br />.._-"'" <br />
