EXHIBIT "B" Hourly Billing Rates and Terms of this Agreement Rates - effective July 1, 1995 Principal: Jerry L. Winges, AlA $88.00 Project Architect: Mark E. Bartos, AlA $68.00 Draftsperson/CAD operator: $58.00 Draftsperson/Technical: $48.00 Clerical: $30.00 Consultants: Services of our Consultants, including ADA specialists, Structural, Mechanical, Electrical and Civil Engineers and Landscape Architects will be billed at a multiple of one and fifteen hundreds (1.15) times the amounts billed to Winges Architecture and Planning for said services. Reimbursable Expenses: Reimbursable expenses including printing, long distance communications, postage and handling of Drawings and Specifications, travel beyond the S.F. Bay Area as authorized by the Owner and fees paid in behalf of the Owner, are billed at a multiple of one and fifteen hundreds (1.15) times the amounts expended by Winges Architecture and Planning, its employees and/or Consultants in the interest of the Project. In-house computer plotting is charged at $7.50 per sheet (24x36). Terms and Payment Policy: This agreement is subject to the following terms and clauses: A. Work will commence upon receipt of a signed agreement. B. Terms will be 15 days upon receipt of invoice. Any balance billed the Client and remaining unpaid for more than 30 days shall bear interest at the rate of 1- 1/2 % per month (18 % per year) until paid. C. Billing will be at the end of each calendar month, or upon completion of the work. If the work is abandoned or stopped, the Client agrees to pay for all work completed. Should any dispute arise over fees or payment, the prevailing party agrees to pay for reasonable attorney's or collection fees. D. Allocation of Risk: Client agrees to limit Architect's total liability to the Client for any and all injuries, claims, losses, expenses, damages or claim expenses arising out of this agreement from any cause or causes, to the amount of $100,000.00. Such causes shall include, but are not limited to, real or alleged professional negligence, acts, errors or omissions, strict liability, breach of contract or breach of warranty. -.
