<br /> " <br /> ORIGINAL <br /> LEASE AGREEMENT <br /> COMMUNICATIONS SITE <br /> (EMERALD LAKE HILLS WATER TANK PROPERTY) <br />THIS LEASE ("Lease"), dated July 29, 1996 is made by and between the CITY OF <br />REDWOOD CITY, a municipal corporation of the State of California ("Lessor") and BAY AREA <br />CELLULAR TELEPHONE COMPANY, a California general partnership doing business as Cellular <br />One ("Lessee"). <br /> RECIT ALS : <br />WHEREAS, Lessor is the owner of certain property situated in San Mateo County, State of <br />California, described in Exhibit "A", attached hereto and incorporated by reference (the "Emerald Lake <br />Hills Water Tank Property"); and <br />WHEREAS, Lessee desires to lease a portion of the Emerald Lake Hills Water Tank <br />Property, as described in Exhibit "B", attached hereto and incorporated by reference (the "Leased <br />Premises") for operation of a Cell Site (defined herein); and <br />WHEREAS, Lessor is willing to permit Lessee to lease the Leased Premises in accordance <br />with the terms, conditions and covenants of this Lease. <br />NOW, THEREFORE, THE PARTÅ’S AGREE AS FOLLOWS: <br />1. PREMISES. Lessor hereby leases to Lessee and Lessee leases from Lessor for <br />the term, at the rental and upon all of the conditions set forth herein, that certain real property referred to <br />herein as the Leased Premises, upon which is located an existing equipment shelter (the "Building") as <br />shown on Exhibit B. Lessee shall use the Building to house its communications equipment, including <br />cellular telephone antennas, which will be located on the roof of the Building. Lessee may use and install <br />on the Leased Premises such other new or existing improvements as are set forth on the plans attached as <br />Exhibit B, which plans are hereby approved by Lessor. Lessor and Lessee hereby agree that the Leased <br />Premises including any Access Areas (defined herein) may be surveyed by a licensed surveyor at the sole <br />cost of Lessee, and such survey shall then supplement Exhibit B, and become a part hereof and shall. <br />subject to Lessor's reasonable approval control to describe the Leased Premises and Access Areas in the <br /> 1. <br /> --- <br />
