<br /> WHEREAS, Lessor and Lessee s predecessor entered mto a Lease Agreement dated July 29, 1996
<br /> whereby Lessor lcased to Lesscc certam Le�sed Premises, therem dcscnbed, that are a porhon of the Emerald
<br /> Lake Hills Water Tank Property located at the 500 [31ock of Cal�form�i Way, Redwood City, CA 94062

<br /> WHEREAS, Lessor and Lessee des�re to extend the term of the Lease, and
<br /> WHEREAS, Lessor and Lessee desire ro modify, as tet forth herem, the rent pay��ble under the Lease,

<br /> WHEREAS, Lessor and Lessee, m the�r mu[u�l mterest, further w�sh to amend the Lease to mclude the
<br /> Site Plan originally prepared by Lessee s predecessor (attached as Exhibit B-1 hereto) as p��rt of Exhib�t B as it
<br /> �s referenced throughout the Le�se but appean to have been madvertently omrtted from the Lease
<br /> NOW THEREFORE, m considerahon of the foregomg and other good and valuable cons�derahon, the
<br /> receipt and suffic�ency of wh�ch are hereby acknowledged, Lessor �nd Lessee agree as follows
<br /> I Term. The Term of the Lease as set forth m Lease Secuon 2 is hereby amended to prov�de a
<br /> third Extended Term of five (5) years ("Third Extended Tenn'), commencmg on July 29, 201 land expinng on
<br /> Iuly 28, 2016 I lereafter, the de�ined tenn "1'crm shall mcludc,d Uie Third Gxtended Term
<br /> 2 Mod�fi�at�on of Rent Commencmg on July 29, 2011, the rent payable for the fust year of the
<br /> Third Extended Term (July 29, 201 I through July 28, 2012) shall be $30,000 00 annually, and shall cont�nue
<br /> dunng the Third Extended Term The annual re��tal payment shall be due and payable m advance on July 29'"
