2. The I.ease Term initially commenced July 29, 1996 and the parties agree to further extend the <br /> Agreement for a new lease term of five (5) years ("New Term") commencing on July, 29, <br /> 2011. <br /> 3. The Lessee leases a portion of the Emerald Lake Hills Water Tank Property (the "Leased <br /> Premises") and said Emerald Lake Hills Water Tank Property is described and/or depicted in <br /> Exhibit 1 annexed hereto. <br /> 4. This Memorandum of First Amendment to Lease is not inte�ded to amend or modify, and <br /> shall not be deemed or construed as amending or modifying, any of the terms, conditions or <br /> provisions of the Lease, all of which are hereby ratified and affirmed. In the event of a <br /> conflict between the provisions of this Memorandum of First Amendme�t to I.ease and the <br /> provisions of the Lease, the provisions of the L.ease shall control.
