The Contractor agrees to permit access to his records of employment, employment <br /> advertisements, application forms, and other pertinent data and records by the State Fait <br /> Employment Practices Commission, or any other agency of the State of California designated <br /> by the awarding authority, for the purposes of investigation to ascertain compliance with the Fair <br /> Employment Practices section of this contract. <br /> a. The Contractor agrees to complete in a timely manner all workforce data forms requested <br /> by the County to show compliance with Affirmative Action requirements. <br /> b. Remedies for Willful Violation <br /> (1) The San Mateo County Human Services Agency may determine a willful violation <br /> of the Fair Employment Practices provision of this addendum to have occurred <br /> upon receipt of a fInal judgment having that effect from a court in an action to <br /> which Contractor was a party, or upon receipt of a written notice from the Fair <br /> Employment Practices Commission that has investigated and determined that the <br /> Contractor has violated the Fair Employment Practices Act and has issued an <br /> order, under Labor Code Section 1426, which has become final, or obtained an <br /> injunction under Labor Code Section 1429. <br /> (2) For willful violation of the Fair Employment Practices/Civil Rights provisions, <br /> the San Mateo County Human Services Agency shaUhave the right to terminate <br /> this contract either in whole or in part, and any loss or damage sustained by the <br /> San Mateo County Human Services Agency in securing the goods or services <br /> hereunder shall be borne and paid for by the Contractor and by his surety under <br /> the performance bond, if any, and the San Mateo County Human Services Agency <br /> may deduct from any money due or that thereafter may become due to the <br /> Contractor, the difference between the price named in the contract and the actual <br /> cost thereof to the state. <br />Child Abuse Reportin~. <br />Contractor agrees to ensure that all known or suspected instances of child abuse or neglect are reported <br />to a child protective agency as defined in Penal Code Section 11165 (k). This responsibility shall <br />include: <br />1. A requirement that all employees, consultants, or agents performing services under this contract <br /> who are reQuireQ by Penal Code Section 11166(a), to report child abuse or neglect, sign a <br /> statement that he or she know of the reporting requirement and will comply with it. <br />2. Establishing procedures to ensure reporting even when employees, consultants, or agents who <br /> are not required to report child abuse under Penal Code 11166(a), gain knowledge of, or <br /> reasonably suspect that a child has been a victim of abuse or neglect. <br />
