<br /> DES:djr OS/21/96 (010/70) <br />installed or constructed or caused to be constructed by Owners, or <br />any of the work done under this agreement, fails to fulfill any of <br />the requirements of this agreement, or the plans and specifications <br />referenced herein, Owners shall upon receipt of a request in writing <br />from City directing the work to be done, without delay and without <br />any cost to City, repair or replace or reconstruct any defective or <br />otherwise unsatisfactory part or parts of the Future Improvements or <br />work. Should Owners fail to act promptly to make such repair, <br />replacement or reconstruction, or to otherwise act in accordance <br />with this requirement to repair, replace reconstruct, should (D,. <br /> or or 0'> - <br />the exigencies of the require repair, replacement 0 <br /> case or -J <br /> - <br />reconstruction to be made before Owners can be notified, the City N <br /> repair, replacement N <br />may, at its option, make the necessary or 0 <br />reconstruction or perform the necessary work and Owners shall pay to <br />City the actual cost of such repair plus fifteen percent (15%). <br /> Notwithstanding any provision to the contrary as set forth in <br />this Agreement, Owners shall not be responsible for repair, <br />replacement, or reconstruction of any Future Improvements, which <br />repair, replacement or reconstruction result from or are caused by <br />Acts of God, civil emergencies, natural disasters, or similar acts <br />which are beyond the Owners' ability to control. <br /> 14. SECURITY TO INSURE GUARANTEE. Owners agree, as a <br />condition precedent to City's acceptance of any of the Future <br />Improvements which are the subject of this agreement, to furnish and <br />file with the City Clerk a bond or deposit of 10% of the estimated <br />cost of said Future Improvements to secure Owners' compliance with <br /> 10 <br /> ~ <br />
