<br /> DES:djk OS/21/96 (010/70) <br /> Owners hereby agree to reimburse City for the full cost and <br />expense of any and all labor and materials used in such construction <br />including, but not limited to, costs of preparation of plans and <br />specifications, other engineering costs, inspection costs, and all <br />administrative overhead of City. In the event Owners fail to pay <br />any and all sums due City on account of such work within 30 days <br />after receipt of billing for such payment, said sums or any unpaid <br />balance thereo f , shall become a lien against the Property, which <br />lien shall take effect upon expiration of said thirty (30) day <br />period, and with respect to which City may record notice or claim <D <br />therefor and otherwise enforce in accordance with the provisions of 01 <br /> 0 <br /> -oJ <br />law. - <br /> N <br /> 2. STANDARDS, APPROVALS. All work to be performed hereunder N <br /> C> <br />shall be in accordance with the standards, specifications, and <br />approvals of City. <br /> 3. LIMITATION UPON ACCEPTANCE OF DEDICATION. Nothing <br />herein contained, nor this agreement, shall be deemed an acceptance <br />by City of any offer or offers for dedication to public use of a <br />portion or any portion of West Oakwood Boulevard not heretofore <br />accepted by a public agency for such purpose. <br /> 4 . ASSESSMENT, OTHER PROCEEDINGS. In the event assessment <br />district proceedings or other proceedings are instituted for the <br />construction of public improvements serving the same or similar <br />purpose as any of the improvements described in paragraph 1 hereof, <br />which provide for an assessment against, or payment by, more than <br />one owner of properties fronting on West Oakwood Boulevard in the <br />vicinity of the Property, and the Property is included in such an <br /> 4 <br /> .- <br />
