<br /> 52 A- \ <br />REPORT <br /> To the Honorable Mayor and City Council <br /> From the City Manager <br />November 22, 2004 <br />Subject <br />Final Acceptance - Construction of Improvements at 490 EI Camino Real <br />Recommendation <br />1. Accept, by motion, the construction improvements at 490 EI Camino Real, and <br /> release the bonds following the submission of a Maintenance Bond in the amount <br /> of $40,000.00, in accordance with paragraph 9 of the Agreement. <br />2. Direct the City Clerk to accept on behalf of the City, the Grant of Sidewalk <br /> Easement and the Grant of Public Service Easement from SFP Whipple, LLC, and <br /> to record a Certificate of Acceptance with the Grant Deeds, in the office of the San <br /> Mateo County recorder. <br />Background <br />On November 3, 2003, the City Council approved the Agreement for Construction of <br />Improvements at 490 EI Camino Real. The owner, SFP Whipple, LLC, has completed <br />the construction of improvements in accordance with the Agreement, the plans and <br />specifications, and to the satisfaction of Engineering and Construction Services. The <br />owner provided a Faithful Performance Bond and a Payment Bond, each in the amount <br />of $400,000.00. <br />In order to provide an enlargement of the curb return radius and a wider right-turn lane <br />on Whipple Avenue (to accommodate southbound vehicular traffic on EI Camino Real, <br />together with traffic signal modification), the property owner was required to dedicate for <br />public use, additional right-of-way for sidewalk purposes and for public services. <br />The current title to this property at 490 EI Camino Real is vested in SFP Whipple, LLC, <br />a California limited liability company.- <br />Alternative <br />The only alternative is to not accept the improvements, which would be contrary to <br />public policy. <br /> erson <br /> munity Development Services Director <br />JKL:ss <br />sIIibrary/reportsllynch_Final Acceptance-490 ECR_ Construction Improvements <br /> ....--.". <br />
