52 A- \ REPORT To the Honorable Mayor and City Council From the City Manager November 22, 2004 Subject Final Acceptance - Construction of Improvements at 490 EI Camino Real Recommendation 1. Accept, by motion, the construction improvements at 490 EI Camino Real, and release the bonds following the submission of a Maintenance Bond in the amount of $40,000.00, in accordance with paragraph 9 of the Agreement. 2. Direct the City Clerk to accept on behalf of the City, the Grant of Sidewalk Easement and the Grant of Public Service Easement from SFP Whipple, LLC, and to record a Certificate of Acceptance with the Grant Deeds, in the office of the San Mateo County recorder. Background On November 3, 2003, the City Council approved the Agreement for Construction of Improvements at 490 EI Camino Real. The owner, SFP Whipple, LLC, has completed the construction of improvements in accordance with the Agreement, the plans and specifications, and to the satisfaction of Engineering and Construction Services. The owner provided a Faithful Performance Bond and a Payment Bond, each in the amount of $400,000.00. In order to provide an enlargement of the curb return radius and a wider right-turn lane on Whipple Avenue (to accommodate southbound vehicular traffic on EI Camino Real, together with traffic signal modification), the property owner was required to dedicate for public use, additional right-of-way for sidewalk purposes and for public services.
