<br />B. Affirmative Action. Contractor certifies that it is in compliance with the Equal <br />Employment Opportunity Requirements of Executive Order No 11246, as amended by Executive <br />Order No 1375, Title VII of the Civil Rights Act of 1964, the California Fair Employment Practices <br />Act and any other federal or state laws pertaining to equal employment opportunity, and that it will <br />not discriminate against any employee or applicant for employment on the basis of race, religion, <br />color, national origin, ancestry, sex, age, physical or mental handicap, marital status, sexual <br />preference, or political affiliation in matters pertaining to hiring, training, upgrading, transfers, <br />compensation or termination. <br />C. Fair Employment Practices <br />(1) In the performance of this Agreement, the Contractor agrees to not discriminate <br />against any employee or applicant for employment because of race, religion, color, national <br />origin, ancestry, sex, age, physical or mental handicap, marital status, sexual preference, or <br />political affiliation. The contractor agrees to take affirmative action to ensure that applicants are <br />employed, and that employees are treated during employment, without regard to their race, <br />religion, color, national origin, ancestry, sex, age, physical or mental handicap, marital status, <br />sexual preference, or political affiliation, Such action shall include, but not be limited to the <br />following: employment, upgrading, demotion or transfers; recruitment or recruitment <br />advertising; layoff or termination; rates of payor other forms of compensation; and selection for <br />training, including apprenticeship. The Contractor agrees to post in conspicuous places, <br />available to employees and applicants for employment, notices to be provided by the San Mateo <br />County Human Services Agency and the Redwood City Housing and Redevelopment Division <br />setting for the provisions of this Fair Employment Practices section. <br />(2) The Contractor agrees to permit access to its records of employment, employment <br />advertisements, application forms, and other pertinent data and records by the State Fair <br />Employment Practices Commission, or any other agency of the State of California designated <br />by the awarding authority, for the purposes of investigation to ascertain compliance v.ith the Fair <br />Employment Practices section of this contract. <br /> a. The Contractor agrees to complete in a timely manner all work force data forms <br />requested by the County to show compliance with Affirmative Action requirements as shown <br />in Exhibit C. <br /> b. Remedies for Willful Violation. <br /> i) The County, City or Redevelopment Agency may determine a willful <br />violation of the Fair Employment Practices provision of this Agreement to ha\'e occurred <br />upon receipt of a final judgment having that effect £rom a court in an action to which <br />Contractor was a party, or upon receipt of a written notice from the Fair Employment <br />Practices Commission that has investigated the Fair Employment Practices Act and has <br />issued an order, under Labor Code Section 1426, which has become final, or obtained <br />an injunction under Labor Code Section 1429. <br />C:\JDM\YFA-OICW.AGT Page 5 <br />ver. 13Sep95 <br />- . - .._. _..~~ - <br /> I <br />
