ORIGINAL RIGHT OF ENTRY (1402 MAPLE ST, APN: 052-392-170) This RIGHT OF ENTRY AGREEMENT ("Agreement"), dated as of August 9, 2017, is made by and between City of Redwood City, a charter city and municipal corporation ("City"), and the County of San Mateo, a political subdivision of the State of California, ("County"), who agree as follows: RECITALS A. City is the owner of that certain real property designated as Assessor's Parcel Number: 052-392-170, situated at 1402 Maple Street in the City of Redwood City ("Property"), County of San Mateo ("County"), State of California, consisting of approximately 4.73 acres, of which a portion of acreage is occupied with temporary structures. The Property is shown on Attachment No. 1, attached hereto and incorporated herein. B. City and County are currently negotiating a Land Swap Agreement ("Land Swap"). C. In order to make an informed decision on whether to proceed with the Land Swap and development of the Property, County wishes to conduct studies and investigations into the physical, geological, and environmental conditions of the Property, including (without limitation) drilling subsurface borings, trenching, and excavation as necessary or desirable for evaluating surface and subsurface conditions ("Studies"). The proposed locations for Studies are shown on Attachment No. 1. D. County understands and acknowledges that County may need to obtain permits from the San Mateo County Environmental Health Division ("Department") to conduct such Studies. E. County seeks to have access to, and City wishes to provide County with access to, the Property in order to conduct all Studies County deems necessary or desirable, subject to the terms hereof. F. The parties acknowledge that the County currently occupies a portion of the Property pursuant to a separate agreement with the City, and the parties agree that such occupation shall not be affected in any way by the terms of this Agreement. AGREEMENT 1. Richt of Entrv. (a) Grant. City grants to County, and its contractors or vendors, a non- exclusive license to enter on the Property to conduct Studies of the real property as County deems necessary or desirable. (b) Term.
