ORIGINAL <br />RIGHT OF ENTRY <br />(1402 MAPLE ST, APN: 052-392-170) <br />This RIGHT OF ENTRY AGREEMENT ("Agreement"), dated as of August 9, 2017, is <br />made by and between City of Redwood City, a charter city and municipal corporation ("City"), <br />and the County of San Mateo, a political subdivision of the State of California, ("County"), who <br />agree as follows: <br />RECITALS <br />A. City is the owner of that certain real property designated as Assessor's Parcel <br />Number: 052-392-170, situated at 1402 Maple Street in the City of Redwood City ("Property"), <br />County of San Mateo ("County"), State of California, consisting of approximately 4.73 acres, of <br />which a portion of acreage is occupied with temporary structures. The Property is shown on <br />Attachment No. 1, attached hereto and incorporated herein. <br />B. City and County are currently negotiating a Land Swap Agreement ("Land Swap"). <br />C. In order to make an informed decision on whether to proceed with the Land Swap <br />and development of the Property, County wishes to conduct studies and investigations into the <br />physical, geological, and environmental conditions of the Property, including (without limitation) <br />drilling subsurface borings, trenching, and excavation as necessary or desirable for evaluating <br />surface and subsurface conditions ("Studies"). The proposed locations for Studies are shown on <br />Attachment No. 1. <br />D. County understands and acknowledges that County may need to obtain permits <br />from the San Mateo County Environmental Health Division ("Department") to conduct such <br />Studies. <br />E. County seeks to have access to, and City wishes to provide County with access to, <br />the Property in order to conduct all Studies County deems necessary or desirable, subject to the <br />terms hereof. <br />F. The parties acknowledge that the County currently occupies a portion of the <br />Property pursuant to a separate agreement with the City, and the parties agree that such occupation <br />shall not be affected in any way by the terms of this Agreement. <br />AGREEMENT <br />1. Richt of Entrv. <br />(a) Grant. City grants to County, and its contractors or vendors, a non- <br />exclusive license to enter on the Property to conduct Studies of the real property as County deems <br />necessary or desirable. <br />(b) Term.
