<br />18.10 Funeral Leave <br /> In the event of a death in the immediate family ofan employee who has one (I) <br /> or more years of seniority with the City, the employee shall, upon request, be <br /> granted such time offwith pay as is necessary to make arrangements for the <br /> funeral and attend same, not to exceed two (2) scheduled duty shifts during the <br /> three (3) consecutive calendar days commencing with the notification of the <br /> death ofthe employee. This provision does not apply ifthe death occurs during <br /> the employee's paid vacation, or while the employee is on leave of absence, <br /> layoff, or sick leave. <br /> For the purposes of this provision, the immediate family shall be restricted to <br /> father, mother, brother, sister, spouse, child, step-father, step-mother, step-sister, <br /> step-brother, step-child, mother-in-law, father-in-law, grandparents, and <br /> grandchildren. At the request of the City, the employee shall furnish a death <br /> certificate and proof of relationship. <br /> Funeral leave applies only in instances in which the employee attends the <br /> funeral, or is required to make funeral arrangements, but is not applicable for <br /> other purposes such as settling the estate of the decreased. <br />18.11 Leave for Union Business <br /> Any employee who shall hereafter be elected or officially appointed to a full- <br /> time paid position in the Union, which position requires absence from the City's <br /> service, shall be granted a leave of absence therefor, and upon retirement from <br /> such position, shall be reinstated; provided, however, that such leave of absence <br /> shall not extend beyond the term of this MOU, unless extended by mutual <br /> consent. <br />18.12 Absence Without Leave <br /> Failure on the part of an employee to report for duty or notify the designated <br /> management official prior to the employee's scheduled starting time as to a <br /> reason why the employee cannot report may subject the employee to <br /> disciplinary action by the City. <br />18.13 Family and Medical Leave Act <br /> 18.13.1 In accordance with the California Family Rights Act of 1991 and the <br /> Family and Medical Leave Act of 1993, regular part-time and full- <br /> time employees with more than one (1) year or more of service are <br /> entitled to a maximum of twelve (12 weeks in a twelve (12) month <br /> period: <br /> 38 <br />
