planning, location, and construction of their joint and several telecommunications facilities within <br />the Public Right-of-Way. Upon completion of the work of improvement under each Construction <br />Improvement Permit, QWEST shall, within thirty (30) days of receipt of the demand of the City <br />Engineer, deliver to the City Engineer such maps, plans, and diagrams as may be required to <br />show, in detail, the exact location, size, depth, and description of the Facilities within the Public <br />Right-of-Way in relation to all other permittee telecommunication facilities. The delivery of these <br />maps, plans, and diagrams to City shall not relieve any third party of any legal or regulatory <br />requirements with respect to location of facilities in the Right-of-Way and shall not be deemed to <br />impose any responsibility or duty (other than the responsibility or duty, if any, imposed by Laws) <br />with respect to any third party. Upon request of the City, QWEST shall pothole its subsurface <br />Facilities, at its sole cost and expense, with respect to any existing City underground utilities, <br />telecommunication, or other City facilities. <br /> <br /> (b) In accordance with the provisions of Chapter 3.1 of Division 5 of Title 1 of the <br />Government Code of the State of California (~ 4216, et seq.), QWEST, as an operator of a <br />subsurface installation, shall obtain and maintain membership in a regional notification center <br />(e.g., Underground Service Alert - Northern California), and shall otherwise comply with the <br />provisions of the referenced chapter, division, and title. QWEST shall furnish wdtten proof of <br />such membership to the City Engineer within thirty (30) days of obtaining such membership. <br />Repeal of any law requiring such membership shall not negate QWEST' obligation to maintain <br />such membership, unless such repeal disbands or eliminates the notification center, and shall <br />not negate any notice requirement to City. <br /> <br /> (c) QWEST agrees to cooperate in the planning, locating and constructing of its <br />Fiber Optic Network Facilities in utility joint trenches or common duct banks with other similar <br />utilities and to participate in cost-sharing for the joint trench and ducts, when such joint utility <br />installations are being planned for or such opportunities exist in any area; provided that such <br />activities do not impair or disrupt Telecommunications Services of QWEST <br /> <br />Agmt-433 14 <br />F:/S hared/Redwood/Council <br />FXS:djk <br />01/04/01 <br /> <br /> <br />
