specifications, and requirements of City which governs the design, construction, installation, and <br /> maintenance of any improvement within the Public Right-of-way entitled, "Engineering <br /> Standards-City of Redwood City," adopted December 16, 1991, as amended. This document is <br /> authored by the Community Development Department of the City of Redwood City, Engineering <br /> Division, and any reference to such document shall include any and all additions, deletions, <br /> revisions, modifications, and updates to this document. This term shall include any and all <br /> documents entitled "General Conditions" or words of similar import, now or hereafter existing, <br /> which directly pertain to all aspects of general construction work. <br /> <br /> "Telecommunications Services" means the transmission of voice, data, video, and <br /> information in rendering teleconferencing and other services, which are permitted to be offered <br /> by QWEST under applicable Laws. <br /> <br /> 2. Term. (a) This Agreement shall be binding on the parties on the date of execution of <br />this Agreement by both parties ("Effective Date"), and shall commence on the first Day after the <br />Effective Date and shall terminate twenty (20) years from the Effective Date (the "Term") or <br />sooner by operating law, mutual agreement of the parties, or as set forth in and pursuant to this <br />Agreement. <br /> <br /> (b) This Agreement shall remain in full force and effect from year-to-year until one party <br />or the other terminates the Agreement. <br /> <br /> 3. Scope of Permit. (a) City hereby agrees to permit QWEST, subject to <br />reservations, covenants and conditions herein contained, to construct, reconstruct, install, <br />reinstall, maintain and operate, replace, relocate and remove Fiber Optic Network Facilities used <br />for Telecommunications Services within Public Right-of-Way that is located within the corporate <br />limits of the City of Redwood City, subject to obtaining all required permits and approvals. <br /> <br /> (b) This Agreement is not a grant by City of any property interest but is made subject <br />and subordinate to the prior and continuing right of City and its assigns to lawfully use any or all <br />of the Public Right-of-Way for City-owned facilities in the performance of its duties, including but <br /> <br />Agmt433 4 <br />F:/Shared/Redwood/Council <br />FXS:djk <br />01/04/01 <br /> <br /> <br />
