A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD CITY DENYING AN APPEAL AND ADOPTING A MITIGATED NEGATIVE DECLARATION AND ADOPTING A MITIGATION MONITORING AND REPORTING PROGRAM FOR A NEW CHARTER ELEMENTARY SCHOOL AT 860 CHARTER STREET WHEREAS, Applicant, Launchpad Development Company, applied for a Conditional Use Permit for non-conforming parking and an Architectural Review Permit to renovate the existing building at 860 Charter Street for a new Rocketship Charter Elementary School with 480 students in Transitional Kindergarten through fifth grade with landscape, parking and on-site circulation improvements (the "Project"); and WHEREAS, pursuant to the requirements of the California Environmental Quality Act (Public Resources Code Section 21000 et seq.; hereafter, "CEQA") and the Guidelines for Implementation of the California Environmental Quality Act (Title 14, Sections 15000 et seq. of the California Code of Regulations; hereafter, the "CEQA Guidelines"), the City prepared an Initial Study/Mitigated Negative Declaration (IS/MND) to assess potential environmental impacts that could result from implementation of the Project; and WHEREAS, the IS/MND concluded that the Project, with the proposed mitigation measures contained in the IS/MND and associated Mitigation Monitoring and Reporting Program (MMRP) prepared by the City, would not have a significant adverse effect on the environment; and WHEREAS, in accordance with CEQA Guidelines Sections 15072 and 15073, a Notice of Intent to adopt the Mitigated Negative Declaration was filed with the County Clerk, sent to the State Office of Planning and Research, advertised in the newspaper, and mailed to property owners and occupants within 300 feet of the subject site to inform the public of the 30-day public review and comment period; and WHEREAS, the IS/MND was published for public review and comment beginning September 30, 2016 and ending November 1, 2016; and WHEREAS, the Applicant has agreed to incorporate in the Project all applicable mitigation measures identified in the IS/MND and the associated MMRP to reduce environmental impacts to a less than significant level; and WHEREAS, on November 1 , 2016 and April 4, 2017, the Commission conducted public hearings to consider the Project and IS/MND and continued the hearings to provide staff and consultants time to respond to comments; and ATTY/RESO.0084/CC RESO ADOPTING CEQA—ROCKETSHIP CHARTER SCHOOL APPEAL REV: 09-05-17 VR Page 1 of 3
