7.A. - Page 16 <br /> application materials, development plan, and all other documents, reports, studies, <br /> memoranda, maps, oral and written testimony, and materials in the City's file for the <br /> applications and the Project, and all adopted City planning documents relating to the <br /> Project and the property including the City's General Plan, Municipal Code, Zoning <br /> Ordinance, and other applicable City laws and regulations, have together served as <br /> an adequate and appropriate evidentiary basis for the findings and actions set forth in <br /> this Resolution. <br /> Section 3. Adoption of Initial Study/Mitigated Negative Declaration and <br /> Mitigation Monitoring and Reporting Program: <br /> a. The IS/MND (attached hereto as Exhibit A) and the associated MMRP <br /> (attached hereto as Exhibit B) are hereby adopted based on the following <br /> findings: <br /> i. The City of Redwood City is the lead agency under CEQA for <br /> preparing the IS/MND, and the City Council is the entity with final <br /> decision-making authority with regard to approval of the Project. <br /> ii. The IS/MND for the Project was presented to the City Council, the City <br /> Council considered the IS/MND, the IS/MND for the Project was <br /> prepared, published, circulated, reviewed and completed in <br /> compliance with State law and CEQA Guidelines, there was adequate <br /> public review of the IS/MND, the City Council has considered all <br /> comments on the IS/MND, the IS/MND adequately discusses all <br /> significant environmental issues, and the IS/MND reflects the <br /> independent judgment and analysis of the City Council. <br /> iii Pursuant to Section 15074 of the CEQA Guidelines, the City Council <br /> finds that there is no substantial evidence that the Project, as <br /> mitigated, will have a significant effect on the environment and that <br /> changes or alterations have been required in, or incorporated into, <br /> the Project which avoid or substantially lessen the significant <br /> environmental effects as identified in the IS/MND. The City Council <br /> hereby adopts the IS/MND and MMRP. <br /> b. Pursuant to Section 15074 of the CEQA Guidelines, the documents and <br /> other materials that constitute the record of proceedings upon which the City <br /> Council based its decision are located in and may be obtained from the <br /> Office of the City Clerk at City Hall, 1017 Middlefield Road, Redwood City, <br /> California. The City Clerk is the custodian of records for all matters before <br /> the City. <br /> Section 4.
