The bases of <br /> the appeal are the failure of the City of Redwood City ("City's through its Planning <br /> Commission to comply with the California Environmental Quality Act ("CEQA"; Public <br /> Resources Code §21000, and Guidelines thereunder) in acting on the Project, and the lack of <br /> any substantial evidence in the record to support the findings required for the Conditional <br /> Use Permit ("CUP') required for the Project under the City's Zoning Ordinance (City <br /> Zoning Ordinance §§ 17.2.F,42.4;see, also, City Zoning Ordinance § 17.13; see, e.g.,KutZke t,. <br /> City of San Diego, 11 Cal. App. 511 1034 (2017). <br /> Your Appeal Filing Form asks that the Appellants attach a list of documents to be <br /> considered at the appeal hearing and that they be attached to the Form. We list below our <br /> submittals, all of which are in your files. In addition, the City files contain additional <br /> voluminous materials on the Project, including purported CEQA analyses such as the LSA <br /> Memorandum, dated February 28, 2017, responding to comments (including those of <br /> Appellants) on the Draft Initial Study/Mitigated Negative Declaration for the Project. We <br /> incorporate in the Appeal Filing Form by this reference all documents, studies, reports, <br /> phone messages, electronic communications, and other material held by the City or its <br /> decision makers (whether on official or personal devices), as part of the record on this <br />
