09/19/2011 ORIGINAL RESOLUTION NO. 15148 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD CITY VACATING A PUBLIC SERVICE EASEMENT ON "PARCEL 2" NEAR MARINE PARKWAY IN CONJUNCTION WITH THE ROUTE 1011RALSTON AVENUE INTERCHANGE IMPROVEMENTS PROJECT WHEREAS, the City of Redwood City ("City") is the record owner of the property, as provided in Document No. 2004-101440 in the Official Records of San Mateo County on May 18, 2004; and WHEREAS, the City of Redwood City was the lead agency on the Route 101/Ralston Avenue Interchange Improvements Project; and WHEREAS, the work of the Route 101/Ralston Avenue Interchange Improvements Project involves various land transfers to the State of California for the purposes of highway interchange improvements; and WHEREAS, the Council accepted the work of the Route 101/Ralston Avenue Interchange Improvements Project on March 24, 2008; and WHEREAS, a condition for authorization to construct the interchange improvements is that land underneath those improvements be granted to the State of California; and WHEREAS, a condition for authorization to construct the interchange improvements is that land granted to the state be free of easements and restrictions; and WHEREAS, to effectuate the above-mentioned grants to the State, the City must vacate a portion of a 5 foot wide public service easement, identified as Parcel 2 and depicted and described on Exhibit "A", attached hereto ("Vacation Area"); and WHEREAS, the City has determined that the Vacation Area identified above is excess; and WHEREAS, there are no public facilities located within the Vacation Area; and WHEREAS, Section 8333(c) of the Streets and Highways Code of the State of California allows a city to summarily vacate a public service easement if `the easement ATTY/RESO.2156/SUMMARY VACATION Reso. # 15148 082211 MUFF # 608
