JAH:djm 03/06/90R (REDEV) <br />JAH:djm 03/19/90R <br />JAH:djm 04/04/90R <br />broad form contractual liability coverage to the extent such <br />coverage is provided subject to standard exclusions, for the <br />Developer's indemnification agreement set forth in this section. <br />The Developer shall also furnish or cause to be furnished to the <br />Agency evidence satisfactory to the Agency that any contractor <br />with whom it has contracted for the performance of work on the <br />Project Site carries workers' compensation insurance as required <br />by law. The Developer also agrees that before its prime <br />contractor commences work on the Project Site, such contractor <br />shall furnish the City and the Agency proof of insurance coverage <br />naming such public agencies, their respective officers, members, <br />agents and employees as co -insureds, under a policy or policies <br />of insurance containing coverage of such risks and in such <br />amounts as are standard for public works contracts of the nature <br />and scope to be constructed on the Project Site. <br />In addition to the insurance requirements of this section <br />the Developer shall assume and be responsible for, and shall <br />protect, indemnify and save harmless, the Agency, the City and <br />their respective officers, members, agents and employees from and <br />against any and all claims, demands, liability, loss or costs, <br />including reasonable attorneys' fees and court costs, for <br />injuries to, or the death of, any person or persons, or damages <br />to property, including property of the Agency or of the City, <br />which may arise out of or in any manner be connected with the <br />Developer's performance of the work called for by this Agreement. <br />The Developer's undertaking and duty to protect, indemnify <br />and save harmless the Agency and the City under this section of <br />the Agreement, shall extend to and cover any claim that may be <br />brought against either the Agency or the City, or both, on the <br />grounds of the discovery of toxic or hazardous materials on the <br />Project Site, where the claim against the Agency or the City is <br />based on the mere ownership by the Agency of one or more <br />Acquisition Parcels for the interval of time necessary for it to <br />perform its obligations under Article 3 of this Agreement; <br />provided that the duties of the Developer under this Paragraph <br />shall not extend to the indemnification of the Agency or the City <br />where either or both the Agency and the City and their respective <br />members, officers, employees, agents or independent contractors <br />bear responsibility, directly or indirectly, for (1) the presence <br />of toxic or hazardous materials on the Project Site or (2) any <br />injuries to, or death of any person or persons, or damage to any <br />property resulting from the presence on the Project Site of the <br />toxic or hazardous materials to which reference is made in (1) of <br />this sentence. <br />§507 City and Other Governmental Agency Permits <br />Before commencement of demolition, construction or <br />development of any buildings, structures or other works of <br />improvement upon the Project Site, the Developer shall, at its <br />own expense, secure or cause to be secured any and all permits <br />which may be required by the City or any other governmental <br />21 <br />
