<br />5. The public interest and necessity require the acquisition of the real property described in <br />said Exhibit" A", and the taking of said real property is necessary for the construction of a 590 space <br />underground public parking garage, and it is hereby directed that said real property described in Exhibit <br />"A" be acquired by the City of Redwood City by eminent domain proceedings as hereinafter set forth. <br />6. Said Public Parking Facility Project is planned and located in the manner that will be <br />most compatible with the greatest public good and the least private injury; that said project will provide <br />increased downtown parking and improve general conditions thus benefiting the general public and that <br />no other reasonable means of providing parking for the downtown area are available to the community <br />and that the aforesaid use to which the property is to be applied, i.e., for parking purposes, is a use <br />authorized by law. <br />7. The City of Redwood City has complied with the environmental review process under <br />the provisions of the California Environmental Quality Act ("CEQA"), found in Public Resources <br />Code Sections 21000, et. seq. and the State CEQA Guidelines adopted by the Secretary of Resources. <br />8. The adoption of a resolution of necessity is not a "project" under Public Resources <br />Code Section 15378 and such activity is exempt from CEQA requirements under Public Resources <br />Code Section 15061(b)(1). <br />9. The Public Parking Facility Project for which the real property described in Exhibit <br />"A" is being acquired is within the scope of the Final Environmental Impact Report and the <br />Addendum to the Final Environmental Impact Report and adequately addresses and analyzes the <br />project for purposes of CEQA. <br />10. The offer required by Section 7267.2 of the Government Code has been made to the <br />owner(s) of record. <br />11. The City Manager and/or the City Attorney and/or the Special Eminent Domain <br />Counsel, the Law Offices of Herman H. Fitzgerald, are authorized and directed to perform all acts <br />necessary on behalf of the City of Redwood City for the acquisition of said interests in real property, <br />and to do any and all other things in connection with such proceedings as in his or their judgment may <br />be necessary or convenient to the successful conclusion of said proceeding or proceedings, including <br /> (page 3 of 4) 14511 <br /> 1111111111111111111111111111111111111111111111111111111 2003-049841 <br /> 02/26/2003 10:41A <br /> R1 Page: 4 of 6 <br />
