Restaurant (units 4 and 5) and Maximum Effect (unit 14). District agrees that in the event Agency <br />expends money toward the eviction, condemnation and relocation of the tenants, or any of them, or <br />their respective successors or assigns, the Costs (as defined below) shall be shared 50150 by District <br />and Agency. The Costs shall be deducted from the payments due the District under the Note as said <br />Costs are incurred. Costs shall include: attorneys' fees, court costs, experts' fees, appraisals, <br />damages to be paid by Agency, severance damages, goodwill damages, and relocation expenses. <br />Agency shall at all times act with respect to these tenants in a manner that will minimize the Costs <br />that may accrue to District when such tenancies are terminated, consistent with Agency's legal <br />obligations. <br />7. District's Use of Broadwav Street Pronertv for Storaee. <br />Agency hereby grants to District a revocable license to use a 5000 square foot area of <br />the Way -To -Go building on the Broadway Avenue Property (the "Licensed Area") for storage of <br />District property. No Hazardous Materials shall be stored by District within the Licensed Area. <br />The specific area comprising the Licensed Area shall be determined by the parties. The Licensed <br />Area shall have access to the loading dock on the Way -To -Go building. District shall, subject to the <br />Agency Directors' written approval, be responsible for partitioning the Licensed Area from other <br />areas of the Way -To -Go building, and shall provide security as deemed necessary by District. <br />Agency shall assume no liability for any loss that may accrue to District as a result of the storage of <br />District property in the Licensed Area. The license provided for in this section shall become <br />effective upon transfer of the Broadway Avenue Property to Agency, and may be revoked by the <br />Agency Directors upon sixty (60) days written notice to District. <br />8.
